Enterprise Rent-A-Car Claim
The Problem
Our client faced a £10,500 claim relating to alleged damage to a rental vehicle. They disputed liability and had not received the original Claim Form.
What Happened
The CCJ was set aside by Consent Order, allowing the underlying claim to be defended.

OVO Energy Judgment
The Problem
Our client was personally pursued for electricity charges relating to commercial premises, despite the account being connected with a limited company and there being no Personal Guarantee.
What Happened
The case involved an incorrectly addressed Claim Form and a substantive defence challenging the client's personal liability.

Three DCB Legal CCJs Set Aside
The Problem
Our client discovered three separate CCJs pursued through DCB Legal. Postal problems meant the original court paperwork had not been received.

Companies House Business CCJ
The Problem
A limited company received a CCJ following late filing of statutory documents and non-receipt of court documentation.
What Happened
An attempt to obtain consent was unsuccessful, so the matter progressed to a contested N244 application and court hearing.

PDC Law Service Charge CCJ
The Problem
Our client had a County Court Judgment arising from alleged residential service charge arrears.
What Happened
Following negotiation with the claimant's solicitors, agreement was reached and a Consent Order was signed and submitted to the Court.

Euro Car Parks / DCB Legal
The Problem
The claim was issued to an address the defendant had never lived at. The defendant was also not the registered keeper or driver of the vehicle concerned.
What Happened
The client had DVLA evidence supporting their position. Copies of the Particulars of Claim were obtained to verify that the claim related to the same vehicle.

Why Can a CCJ Be Set Aside?
The circumstances behind a County Court Judgment can vary considerably. Our case studies include clients who did not receive the original Claim Form, claims sent to incorrect addresses, judgments involving disputed debts, parking related CCJs, business judgments and cases where the wrong individual had been pursued.
Depending on the circumstances, it may be possible to seek agreement with the claimant through a Consent Order or make an application to the Court using Form N244.
